CORNWALL DISABLED ASSOCIATION INFORMATION SHEET

Making a Will

The most important document you may ever write is your last will and testament, yet two thirds of us do not have one.

What happens if you do not make a Will?

If you don’t make a will you die ‘intestate’ and your property and possessions (your estate) will be distributed according to the law, rather than according to your own wishes, so your friends, favourite charities and some much loved relatives may get nothing.

If you have no will and no known relatives your estate will go to the Crown.

If you make a will you can avoid this happening and make things easier for those you leave behind.

You may not think you have a lot to leave but if you were to add up the value of your possessions and property you may be surprised.

A will is essential if you want to make a gift to somebody beyond your immediate family.

At a time of bereavement, a will can save your family a considerable amount of worry.

How do you go about making a Will?

It is quite simple. Make a list of what you own. Then, decide what specific gifts you wish to give people and what you want to do with the remainder of your property. You don’t have to mention every item you own in a will.

Do you need a solicitor to draw up your Will?

It is possible to do it yourself but it is not advisable

Executors

The executor is the person you choose to take charge of the administration of your estate, you can appoint up to four. They are usually friends, members of your family, solicitors or banks.
